PARTICIPATION AGREEMENT, RELEASE OF LIABILITY, ASSUMPTION OF RISK, INDEMNIFICATION, AND PHOTO/VIDEO RELEASE (ALL AGES)

This Participation Agreement and Release (“Agreement”) is entered into by the undersigned participant (“Participant,” “I,” or “Me”) in favor of Kombat Enterprises LLC, including its owners, officers, members, agents, contractors, representatives, coaches/instructors, and affiliates (collectively, “Kombat Enterprises”). This Agreement applies to any and all Kombat Enterprises activities, classes, sessions, events, workshops, pop-ups, demonstrations, training sessions, self-defense sessions, kickboxing sessions, conditioning sessions, and related activities held at any location, including public parks, outdoor spaces, rented facilities, and other venues in Arizona, including Queen Creek, Gilbert, and Chandler (collectively, the “Activities”).

1) AGE ACKNOWLEDGMENT

• I acknowledge that I am participating voluntarily.

• If I am under 18 years old, my parent or legal guardian has signed below giving consent for me to participate.

• Minors are required to be supervised and accompanied as instructed by Kombat Enterprises.

2) ACKNOWLEDGMENT OF INHERENT RISKS

• I understand the Activities involve physical exertion and may include kickboxing training, shadowboxing, partner drills, pad work, self-defense techniques, and conditioning exercises.

• I understand these Activities involve risks including sprains, strains, bruises, cuts, broken bones, head/neck/spinal injuries, heat illness, dehydration, fainting, and injuries from equipment or other participants.

• I voluntarily choose to participate with full knowledge of these risks.

3) VOLUNTARY PARTICIPATION + FITNESS TO PARTICIPATE

• I certify that I am physically and mentally capable of participating.

• I understand Kombat Enterprises is not responsible for screening my fitness level.

• If I have a medical condition or am pregnant, I will consult a physician before participating.

4) SAFETY RULES + PROPER ATTIRE

• I agree to follow all safety instructions, rules, and coaching guidance.

• I will wear proper athletic attire, including closed-toe athletic/gym shoes and comfortable workout clothing.

• I understand Kombat Enterprises may remove participants not following safety rules or wearing proper attire.

5) EQUIPMENT USE + PERSONAL PROPERTY

• Kombat Enterprises may provide training equipment (gloves, pads, wraps, etc.). I will use equipment responsibly.

• I may bring my own equipment, and I am responsible for its condition and safety.

• Kombat Enterprises is not responsible for loss or damage to personal property.

6) RELEASE OF LIABILITY

• I release, waive, and discharge Kombat Enterprises from any claims, damages, losses, or liabilities arising out of my participation, including claims arising from negligence.

• This release applies to all injuries or accidents occurring before, during, or after participation.

7) INDEMNIFICATION

• I agree to indemnify and hold harmless Kombat Enterprises from any claims, damages, or attorney fees arising from my participation, including any violation of rules or instructions.

8) MEDICAL TREATMENT AUTHORIZATION

• In case of injury or illness, I authorize Kombat Enterprises to provide basic first aid or seek emergency medical care.

• I understand that a first aid kit and CPR-certified personnel may be present, but an AED may not always be available.

• I am responsible for all medical costs.

9) PAYMENT + REFUND POLICY

• Participation is paid. All sales are final unless Kombat Enterprises cancels the event.

• Refunds or credits for cancellations are at Kombat Enterprises’ discretion.

10) PHOTO/VIDEO RELEASE

• I consent to photographs and videos being taken during participation.

• I grant Kombat Enterprises the right to use my or my child’s likeness in marketing materials, social media, website, or promotional content without compensation.

11) SEVERABILITY

• If any part of this Agreement is invalid or unenforceable, the rest remains in full effect.

12) GOVERNING LAW / VENUE

• This Agreement is governed by Arizona law. Any dispute shall be resolved in a court of competent jurisdiction in Arizona.

13) ELECTRONIC ACCEPTANCE + SIGNATURE

• By registering or electronically accepting this Agreement, I acknowledge that I have read and understand this Agreement, accept the risks, and agree to its terms.
